Link or Die – It’s That Simple

We’re not talking your untimely end, of course, but the slow death of your website! Maybe you’re all too familiar with the scenario?

Website ranks on page one of your favourite search engine. Before you can give yourself a much-deserved slap on the back it slips a little, then slides some more. Page one is just a distant memory as page two gives way to page three… Finally you sink so low the only way left is up.

So what’s gone wrong? The website looks good, has great content and you’ve correctly identified the market niche. There are appropriate keywords in the ‘title’, ‘alt’ and ‘H1′ and ‘H2′ tags, and you’ve also sprinkled them throughout each page at a reasonable density level, with the odd ‘b’ tag thrown in for good measure.

The truth is you’ve done nothing wrong, at least in terms of on-page optimization. Nowadays, though, it’s very much less than half the battle. Very much less. Once upon-a-time, before Google and PageRank, on-page optimization was all you needed to rank highly in the search engines. Not any more.

Now ‘off-page’ optimization, or links to be more precise, is everything. And without links, either one-way or reciprocal, your link popularity stays at zero and you won’t rank for any competitive keyword or phrase.

The concept is devilishly simple from the search engine’s point of view. Every link is a thumbs-up or ‘vote’ for the page it points to. In simple terms, the more votes the better the page ranks.

Well, not quite, because there are good links and there are bad links and learning to spot which is which can make all the difference.

The best links are one-way links. Other websites link to you because your site is so full of interesting and informative content they simply have to tell the rest of the world about you.

Great if you can get them but for most of us who don’t have a site to rival CNN or the BBC, such spontaneous linking is a rarity.

Of course, if you’ve a pile of spare cash lying about then you can buy one-way links instead. But it’ll cost and if Google and the other search engines even suspect that that’s what you’re doing – buying links in order to inflate your link popularity – then watch out. You will be tagged as a spammer and suffer the consequences. Not worth the risk!

So, for the vast majority of us, reciprocal links is our only option. You know how it goes – A links to B in return for B linking back to A. And no matter what you may have read to the contrary, reciprocal linking does still work.

The problem is you’ve got to exchange links with a lot of other websites in order to make an impact, especially if your field is a competitive one. And the site or page your link is on has to loosely match the theme of your website for maximum benefit.

Make sure, too, the page doesn’t have too many other links on it. Around 10 to 20 is ideal, 30 or so is fine but anything higher than that then be cautious. A page with dozens of links on it is nothing more than a ‘link farm’ and should be avoided. Google and the other search engines hate them.

Reciprocal linking is a time-consuming process, often frustrating but worth the hard work. It will pay handsome dividends long term so don’t ignore it. Link or die, it really is that simple.

New Bankruptcy Law – A Summary of Changes You Should Know About

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, aka the “new bankruptcy law”, became effective October 17, 2005. The law introduces several changes to the existing bankruptcy rules. Some of these changes include the fact that potential bankruptcy filers must meet a “means test”. The test determines, whether you are eligible to file for bankruptcy or not.

The term “Creditor” refers to those organizations owed money. “Debtor” refers to the consumer who owes money. “Filer” refers to the consumer filing for bankruptcy.

Here is a summary of the major changes:

“Means Test” for Chapter 7
A creditor may file a motion to dismiss a bankruptcy case, if the debtor’s income is greater than the median state income and the debtor can afford to pay $100 per month over a period of five years towards paying down your debts. In this case, a debtor has to file for Chapter 13 instead of Chapter 7.

Mandatory Credit Counseling
Potential bankruptcy filers must undergo credit counseling via an “approved nonprofit budget and credit counseling agency”, prior to filing for bankruptcy. Here is the list of government approved consumer credit counseling agencies.

Mandatory Debtor Education
Chapter 13 filers must complete a course in “personal financial management” prior to filing for bankruptcy.

Discharge of Debts
Certain debts cannot be discharged. Debts to a single creditor of more than $500 for luxury goods that were incurred 90 days before filing cannot be discharged. In addition, cash advances of $750 within 70 days are also non-dischargeable.

Proof of Income and Tax Return Filings
Filers must show proof that they paid taxes from the last year. This also provides verification of income. If a filer has not paid taxes for the previous year, they must pay before they can continue the bankruptcy process.

Time between Discharge
If you are filing for Chapter 7 and you have a previous discharge within the last 8 years – you cannot receive another discharge. This time period used to be 6 years.

Fewer “Automatic Stay” Protections
Filers will no longer enjoy some of the legal protections they used to have such as stopping or delaying evictions, driver’s license suspensions or child support proceedings.

Attorney Verification Required
Attorneys are responsible for verifying that information contained in petitions and schedules are “well grounded in fact.” Attorneys are required to sign petitions to acknowledge this fact.

Eviction Proceedings
Filing for bankruptcy will not stop an eviction proceeding.

Priority For Unpaid Child Support and Alimony
The repayment of unpaid child support and alimony take priority over any other creditor.

Retirement and college savings gain protection
Funds in retirement accounts such as 401K, 403b and IRAs are deemed as assets that are not available to creditors as part of the bankruptcy. Debtors can continue to contribute to these accounts, if they can. Additional accounts that are exempt are college savings funds for children.

Filing Chapter 11 Bankruptcy

Chapter 11 is by and large used for business bankruptcies and restructuring. It not considered as a viable option for individual consumers given that it is far more complex and expensive to pursue.

Chapter 11 permits businesses an opportunity to reorganize themselves, allowing them a chance to restructure their debt and get out from beneath specific troublesome deeds and agreements. Normally, a business is permitted to carry on functioning at the same time as it is in Chapter 11 under the watchful eye of the Bankruptcy Court and its appointees.

Another option that can be utilized under is Chapter 11 is to liquidate the assets of the business and reimburse the creditors from the realization. It is known that a Chapter 11 liquidation frequently achieves a higher realization for the creditors than a Chapter 7 bankruptcy.

Small business owners with a debt of less than $2000 can ask to be elected and treated as a “”small business”". By doing so, the government would put the case on a fast track and would be treated differently than a regular Chapter 11 case. The debtor would no longer require a separate hearing to approve the disclosure statement, it may be joint with the confirmation hearing.     Budgeting means sitting down with an adviser, such as an accountant, and working out a plan to enable you to live and progressively pay off all debts. A good budget strictly adhered to, would soon pull you “out of the cart” if you are prepared.

  4. Refinancing.
    You may like to look at refinancing some assets and using the surplus cash to pay off creditors who can cause problems by lodging a creditor’s petition for bankruptcy if they are not happy.

  5. Creditor’s pool.
    You can always try and arrange with your creditors to clear up their debts by instalment payments. Here you will need to see all your creditors and create a creditors pool, run by an accountant or solicitor. You will pay a certain amount of money into the pool and that money can be distributed to the creditors until their debts are paid.

  6. Compromise.
    You can reach an agreement with your creditors on a proposition where their debts can be fully settled. There are a number of ways to agree on a compromise with creditors.

  7. Instalment Order.
    This is an order made by a Court allowing you to pay back debts in easy stages without the threat of further legal action, while that order is in force. This is probably a good option, because it forces your creditors to accept the arrangement as long as someone the court appoints properly monitors it.

  8. Continue trading.
    If your business is temporarily insolvent then you should look at ways where it can still continue trading and hopefully generate good cash flow to meet your commitments. If you can, it is good to trade your way out of your financial difficulties. Most businesses can do this unless they are so far gone that recovery is impossible. For you to continue trading it is recommended that you talk to a professional adviser who can act as a guidance counsellor or coach, so you don’t get into deeper problems.

  9. Bankruptcy.
    If you have tried all other actions and they have not been successful or agreed to by your creditors, then you should consider filing for voluntary bankruptcy in order to stop the deterioration of the situation.

If you can avoid bankruptcy in any way at all – do so.
If all else fails and it looks like you or your business is at the end of the road – talk to an accountant and lawyer immediately.
